Oklahoma Drug Use: Marijuana Possession and Cultivation Laws in Oklahoma

When it comes to drug use in Oklahoma, one often thinks of methamphetamine, since the state generally leads the nation in the illegal manufacture of the drug and in meth addiction. However, probably the most commonly used drug in Oklahoma is marijuana.

Oklahoma is notorious for its strict drug laws, which seems ironic for a state in which marijuana grows freely in the wild. In fact, in 2008, deputies in McClain County discovered several acres of wild marijuana plants growing as high as six feet tall. Deputies said that the marijuana was “low quality” because it had not been planted or cultivated, and they destroyed the crop to “get rid of it so the temptation is not here.” Had the marijuana been cultivated, rather than wild, the person responsible would have been subject to felony charges. Marijuana cultivation in Oklahoma is a felony regardless of the amount grown, and consequences of conviction include two years to life in prison and $ 10,000 – $ 50,000 in fines.

In fact, only first-offense marijuana possession and possession of drug paraphernalia are misdemeanors under Oklahoma drug laws. All remaining drug crimes are felonies; some drug activity, such as selling to minors or trafficking near a school, result in enhanced sentencing.

While the Food and Drug Administration ruled in 1937 that marijuana had no medical use and thus removed it from the marketplace, fourteen states and the District of Columbia have since approved medical marijuana.
